Privacy Policy - Driver

FRAYT Technologies, Inc. ("FRAYT," "we," "us," or "our") provides a delivery marketplace connecting businesses that need items transported ("Customers") with independent transportation carriers ("Drivers"). This Privacy Policy explains what personal information we collect, why we collect it, who we share it with, how long we keep it, and the rights you have over it.

This Privacy Policy applies to the FRAYT Driver mobile application (the "Driver App"), the FRAYT Customer applications, our websites, and any other service that links to this Privacy Policy (together, the "Services").

If you are a Driver or a Driver applicant, Sections 3, 4, 5 and 6 describe practices that apply specifically to you, including facial verification, background checks, and location tracking. Please read them.

1. Scope

This Privacy Policy applies to personal information we process as a controller — meaning we determine why and how it is processed.

"Personal information" means information that identifies, relates to, or is reasonably capable of being linked with a particular individual or household, and that is protected under an applicable privacy law. It does not include information that has been aggregated, anonymized, or de-identified so that it can no longer be linked to an individual, which we may use for any purpose.

1.1 Delivery records are not information about you

When you complete a delivery, the Driver App captures records about the shipment: photographs taken at pickup and drop-off, bills of lading, barcode scans, and the recipient's signature. These are records of the transaction, created for the Customer, and we treat them as the Customer's delivery records rather than as personal information about you.

We describe them here because you create them through the Driver App and because they may contain information about other people — a recipient's signature, or a person or address visible in a photograph. Our handling of that information is described in Section 6.2 and in the agreements governing our Customers' use of the Services.

2. Personal Information We Collect

2.3 Sensitive personal information

Certain categories above are treated as sensitive personal information under the California Consumer Privacy Act and comparable state laws:

  • your driver's license number;
  • your Social Security number;
  • your precise geographic location; and
  • your biometric information.

We collect and use sensitive personal information only for the purposes described in this Policy — verifying your identity and eligibility, providing the Services, paying you, and meeting our legal obligations. We do not use or disclose sensitive personal information to infer characteristics about you. Section 8 explains your right to limit its use.

2.4 Information from other sources

We receive information about you from background-check providers, vehicle-data providers, payment and payout processors, Customers, and other users of the Services.

3. Facial Verification (Biometric Information)

This Section is our written policy on biometric information.

3.1 What we collect and why

To confirm that the person applying is the person shown on the driver's license, we ask you to take a photograph of your face. A service provider compares that photograph against the photograph on your driver's license and returns a similarity score and a match indication. We use the result to decide whether your application proceeds or is referred for human review.

We collect this information for one purpose: verifying your identity. We do not use it to identify you in any other context.

3.2 What is and is not stored

  • We store your selfie, your driver's license images, and the similarity score and match
    indication.
  • We do not create or store a faceprint, face template, or other mathematical representation of
    your face. The comparison our provider performs is stateless: it compares two images and returns a score, and it does not enroll you in any facial-recognition database.
  • Your images and the comparison result are not used to train any facial-recognition system.

3.3 Who receives it

The facial comparison is performed by Amazon Web Services (Amazon Rekognition). Your driver's license images are additionally processed by Amazon Web Services (Amazon Textract) to read the text on them, and by Anthropic, a generative artificial-intelligence vision provider, to confirm the document is a genuine driver's license. Because your license photograph shows your face, that image contains biometric information when it is processed by these providers.

No other party receives your selfie or the comparison result. We do not sell, lease, trade, or otherwise profit from your biometric information.

3.4 How long we keep it and when we destroy it

While you are onboarding and while you are performing services for FRAYT, we keep this information for the purpose described in Section 3.1.

  • If you do not complete onboarding, we delete it within 364 days of your application becoming inactive.
  • If you complete onboarding and later stop performing services for FRAYT, we delete it within 1 year of your account being deactivated, unless the law requires us to keep it longer. Your account is deactivated when you or FRAYT end your ability to perform services through the Driver App, whether by your request, by FRAYT's action, or after a period of inactivity we define in our internal policies.

We destroy it sooner if the purpose in Section 3.1 is satisfied first. A litigation hold or an active dispute suspends these periods for the records it covers, and only while it is in force. These are the same periods stated in the Biometric Data Notice and Consent.

3.5 Your consent

We collect your selfie only after you agree to this Section and to the separate Biometric Data Notice and Consent, which is presented before we collect any image of your face. You are not required to apply to drive with FRAYT. If you do not consent, we cannot verify your identity and cannot approve your application.

Illinois, Texas, and Washington residents: this Section and the Biometric Data Notice and Consent are provided to satisfy the Illinois Biometric Information Privacy Act, the Texas Capture or Use of Biometric Identifier Act, and Washington Revised Code Chapter 19.375.

4. Background Checks

To drive on the FRAYT platform you must pass a background check. The check is a consumer report under the federal Fair Credit Reporting Act.

  • The check is performed by Turn Technologies, Inc. ("Turn"), a consumer reporting agency.
  • You provide your Social Security number and your authorization directly to the provider,
    through the provider's own form. FRAYT does not collect or store your Social Security number for the background check.
  • We receive and store the results of the check — the status and outcome of each component.
  • Before the check is run, you receive a separate written disclosure and give written
    authorization, as the Fair Credit Reporting Act requires. Those are standalone documents; they are not part of this Privacy Policy.
  • If information in a consumer report causes us to decline your application, you have rights under
    the Fair Credit Reporting Act, including the right to receive a copy of the report and a summary of your rights, and an opportunity to dispute its accuracy before the decision becomes final.

Your Social Security number. You are asked for it at three points, and they are separate from one another.

  • We collect one copy ourselves, in the Driver App, at the background-check step. We use it to
    report what we pay you to tax authorities. We store it in encrypted form, and we do not send it to the background-check provider or to the payout provider.
  • The background-check provider collects its own copy in its own form, as described above.
  • The payout provider collects its own copy when you set up payment. That collection happens in
    the provider's own flow and is described in Section 6.1.

5. Location Information

Location is the most significant information the Driver App collects. This Section describes it precisely.

5.1 What we collect

When you are signed in to the Driver App, we collect your precise geographic location, including while the app is in the background and while your phone is locked. Your device displays an indicator when this is happening.

5.2 When we collect it

  • Collection begins when you sign in to the Driver App.
  • Collection continues while you remain signed in, including when the app is in the background
    and when no delivery is in progress.
  • Collection ends when you sign out.

Precision varies with what you are doing. While you are performing a delivery, we collect precise
location at high accuracy. At other times, while you remain signed in, we reduce the accuracy and
allow your device to pause updates when you are not moving. Collection does not stop between
deliveries — only its precision and frequency are reduced.

5.3 Why we collect it

  • To offer you trips near you.
  • To provide turn-by-turn navigation during a delivery.
  • To detect that you have arrived at a pickup or drop-off.
  • To show a Customer where their delivery is.
  • To resolve disputes about whether and when a delivery occurred.

5.4 Who sees it

While you are performing a delivery, the Customer for that delivery can see your location and route. FRAYT personnel can see it for support, safety, and dispute resolution. Our mapping and navigation provider processes it to generate routes.

5.5 Your control

You can turn off location permission at any time in your device settings. If you do, the Driver App cannot offer you trips, navigate, or record deliveries, and you will not be able to work through the platform. Turning off location does not delete location we already collected.

6. How We Share Personal Information

6.1 Service providers

We share personal information with providers that perform services for us, under contracts that restrict them to those purposes.

6.2 Customers and recipients

For Drivers, we share your name, photograph, telephone number, vehicle information, and location and route with the Customer whose delivery you are performing, and with the recipient of that delivery where necessary to complete it.

Delivery records described in Section 1.1 — including photographs and signatures captured at delivery — are provided to the Customer as proof of the delivery.

6.3 Other disclosures

  • Legal and safety. When required by law or legal process; to establish, exercise, or defend
    legal claims; to investigate fraud or misuse of the Services; or, in urgent circumstances, to protect the health or safety of any person.
  • Business transfers. In connection with a merger, acquisition, financing, or sale of assets,
    in which case we will require the recipient to honor this Policy or notify you of any change.
  • With your direction. When you ask us to share it.

6.4 What we do not do

  • We do not sell personal information, as "sell" is defined under applicable state privacy laws.
  • We do not share personal information for cross-context behavioral advertising.
  • We do not use personal information to serve you advertisements, and the Driver App contains no
    advertising or advertising-measurement technology.
  • We do not process sensitive personal information to infer characteristics about you.

Because we do not sell or share personal information, we do not offer a "Do Not Sell or Share My Personal Information" link. If that ever changes, we will provide one and update this Policy first.

7. How Long We Keep Personal Information

We keep personal information for as long as needed for the purpose it was collected for, and then for as long as required to meet our legal, tax, insurance, and recordkeeping obligations or to establish or defend legal claims. For biometric information in particular, we keep it no longer than is reasonably necessary for the purpose it was collected for, consistent with applicable biometric privacy laws. These periods are suspended, for the records they cover, when a litigation hold, government investigation, audit, or a claim we reasonably anticipate requires us to preserve them, and resume once that hold, investigation, audit, or claim is resolved.

We store personal information in the United States. Our providers may store it in the United States or elsewhere.

8. Your Privacy Rights

Subject to verification and to exceptions under applicable law, you may:

  1. Know what personal information we have collected about you, where it came from, why we
    collected it, and who we disclosed it to.
  2. Access a copy of that information.
  3. Correct inaccurate personal information.
  4. Delete your personal information. See Section 9.
  5. Limit our use and disclosure of sensitive personal information to what is necessary to
    provide the Services.
  6. Not be discriminated against for exercising any of these rights.

8.1 How to make a request

Email info@frayt.com, or use the Delete Account option in the Driver App.

8.2 Verification

To protect your information we will ask you to verify your identity before we act on a request to know, correct, or delete. If we cannot verify you, we cannot complete the request.

8.3 Authorized agents and appeals

You may use an authorized agent, who must provide signed written permission; we may still verify your identity. If we decline a request, you may appeal by writing to the address in Section 8.1.

8.4 Response times

We acknowledge a request within 10 business days and complete it within 45 days. Where a request is complex or numerous, we may extend once by a further 45 days and will tell you why within the first 45.

9. Deleting Your Account

You can request deletion of your account from the Driver App, or by contacting us at the address in Section 8.1.

What happens. Your account is closed, you are signed out of every device, and you can no longer access the Services. Your personal information is deleted or de-identified except where we are required or permitted to keep it, in accordance with Section 7 above.

How long it takes. We acknowledge your request within 10 business days and complete deletion within 45 days, extendable once by a further 45 days with notice.

10. Automated Decision-Making

Parts of the application process are automated. Software checks whether your driver's license has expired, compares the information you enter against the information read from your documents, compares your selfie against your license photograph, and validates your vehicle. These checks can stop your application or refer it for human review.

A human reviews an application before it is finally declined. No automated check declines an application on its own.

If your application is declined because of the background check, the Fair Credit Reporting Act process in Section 4 applies.

11. Security

We use administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, and disclosure. No system is perfectly secure, and we cannot guarantee the security of personal information.

You are responsible for keeping your password confidential. Tell us immediately if you believe your account has been compromised.

12. Children

The Services are not directed to children. You must be at least 18 years old to use the Services as a Customer and at least 21 years old to apply as a Driver. We do not knowingly collect personal information from anyone under 18.

13. Other Websites

The Services may link to websites we do not operate, including the sites of our background-check, payout, and payment providers. This Policy does not apply to them. Review their privacy policies before providing information.

14. Accessibility

If you need this Policy in an alternative format, contact us at the address in Section 16 and we will work to meet your needs.

15. Changes to This Policy

We may update this Policy. When we do, we will change the "Last updated" date and, where the change is material, we will notify you and ask you to review the updated Policy before you continue using the Services. Prior versions remain available, and the version you accepted remains identifiable.
